Limitation of actions
Limitation of actions refers to the statutory time limits within which a claim must be brought. Under section 2 of the Limitation Act 1980, an action founded on tort may not be brought after the expiration of six years from the date on which the cause of action accrued. Section 5 provides the same period of six years for actions founded on simple contract. Different periods apply to personal injury claims and to claims on specialty. After expiry, the defendant can rely on the limitation period as a defence. Sections 2 and 5 of the Limitation Act 1980 apply to England and Wales.
