Abmahnung (formal cease-and-desist warning)
Out-of-court demand to stop a specific conduct — usually combined with a cease-and-desist declaration and lawyer's fees.
An Abmahnung is the formal, out-of-court demand to stop an alleged infringement. It is a classic of German unfair-competition, copyright and trademark law (§ 13 UWG, § 97a UrhG). It usually comes with a cease-and-desist declaration, a damages claim and a demand for cost reimbursement. Always have the pre-drafted cease-and-desist declaration reviewed by a lawyer before signing — contractual penalties can become expensive later.
