Anyone who fails to provide a due payment or service despite a reminder (or a fixed deadline) is in default — from that point on, default interest can be claimed.

Default generally requires a reminder after the due date (§ 286 Abs. 1 BGB (German Civil Code)). It occurs without a reminder if the time for performance is determined by the calendar, or no later than 30 days after the due date and receipt of an invoice — in the case of consumers, only if the invoice points out this consequence (§ 286 Abs. 3 BGB). From the beginning of the default, the debtor owes default interest (§ 288 BGB) and must compensate for further damages caused by the default.
