Family, social and tax law: notice review with automatic deadline extension is live

15 new use cases from the job centre notice to the tax assessment — and an automatic review of the legal remedy instruction that correctly extends the deadline when the instruction is defective (§ 58 VwGO, § 356 AO, § 66 SGG).

What this is about

Administrative decisions — from a Jobcenter notice to a health-insurance rejection to a tax assessment — are regularly defective in form. An incorrect or missing right-to-appeal notice (Rechtsbehelfsbelehrung) extends the objection deadline by law from one month to up to one year. In practice, almost nobody knows this.

What's new

  • Automatic notice review. Every analysis now recognises whether a document is a formal administrative act, and checks the right-to-appeal notice for form, deadline, addressee and the correct legal basis. Defects are named specifically.
  • The correct deadline instead of the standard deadline. Where there are defects, the deadline extends under Section 58 VwGO (administrative law), Section 356 AO (tax law), or Section 66 SGG (social law) to up to one year. We calculate it and show you the effective deadline directly in the result.
  • 15 new use cases:

- Family law: maintenance disclosure, youth-welfare-office letters, divorce petitions, contact/access arrangements.

- Social law: Jobcenter (SGB II), Federal Employment Agency (unemployment benefit I, blocking period), social welfare office (SGB XII), health insurance, pension insurance (DRV) notices, SGB I duties to cooperate, hearings before withdrawal/reimbursement (Section 24 SGB X).

- Administrative and tax law: tax assessment notices, objection decisions, administrative notices (housing benefit, BAföG student support, child benefit, parental allowance), hearings under Section 28 VwVfG.

  • Three new legal-area categories in the overview: family law, social law, and administrative & tax law.
