Prozesskostenhilfe: Help when funds are lacking

Who receives PKH, how the application process works, and why we do not invent allowance amounts – with reference to the official form.

Updated 4 October 2026

Even those with limited financial means should be able to enforce their rights. For this purpose, Prozesskostenhilfe (PKH) (legal aid) is available pursuant to §§ 114 ff. ZPO (Zivilprozessordnung - German Code of Civil Procedure). The state then covers the court and attorney fees in full or in part – depending on your income, either without repayment or in monthly installments.

Three Requirements

  1. Need (Bedürftigkeit) – You are unable to cover the costs (or can only do so in installments) based on your personal and financial circumstances.
  2. Sufficient prospect of success (Hinreichende Erfolgsaussicht) – Your lawsuit or defense must not be futile from the outset.
  3. No mutwilligkeit (absence of wantonness) – A reasonable person would also pursue the dispute at their own expense.

How the application process works

You fill out the official form "Erklärung über die persönlichen und wirtschaftlichen Verhältnisse" (Declaration of Personal and Financial Circumstances), attach supporting documents (income, rent, maintenance/alimony), and submit everything to the trial court – usually together with the lawsuit. The court decides on the approval.

Why we do not state specific amounts

The allowance thresholds (Freibeträge) change annually (they are adjusted via official announcements). An invented or outdated figure would be risky. The official form and the assessment by the court are decisive – if in doubt, please inquire at the Rechtsantragstelle (legal application office) of the court.

Important

PKH does not cover the risk of having to bear the costs of the opposing party in the event of a loss (What does a lawsuit cost? Understanding the cost risk). If you have legal expenses insurance, a confirmation of coverage (Deckungszusage) may also be considered.
